gesture still coming on during sleep

My Venus 2 plus is set to not allow gestures at night, but they still come on *sometimes* - I thought the issue was resolved, but it has started again.

I should note I am running 8.12 software and am using stock Garmin screens... and confirmed that gesture should be off between 9:45p-5:30a.
