If I disable "lap key" from an activity then when I pause it the Lap option is missing. If I enable it then the option is available. My old Instinct Solar maintained it either way.

I think it makes sense from a consistency perspective. You could put in a feature request however. I’m not sure of your use case. If you are worried about pushing the lap button accidentally then you would also worry about the Stop/Pause button?? I use a hot key to lock and unlock the buttons when I’m doing something that might have accidental pushes (or you use auto lock)
Trivial use case: possibility to go into altimeter or any other widget without pausing the activity. Not a big deal for me (no risk of pressing lap key), but I found this different from my older device
If I understood right, you could try this (I've done it on my Fenix 5+): disable the lap key, but assign long press of the lap key as a hotkey for lap. That way you can still change laps with a long press, but don't have the risk of changing it by an accidental short press.
