Can I have my 299 EUR back??

Some time ago I pruchased an Instinct watch...

The only “positive” point is that the “watch” can reproduce time more or less accurately, and the date… if you “synchronise” the thing every week.

  • Heart rate is not working correctly… 10 minutes work-out and I’m still at 60 bpm… when I’m cooled down again, the HR starts to rise…
  • Barometric pressure is not working: 30% drops in seconds
  • Height indication depends on the barometer…do not ride a bike… you will fall 200-300m just by riding at 20km/h…. for a world-renowned GPS manufacturer, you would expect them to know where you are. But no, correcting with GPS is too difficult.
  • the "opening" to "measure" the pressure is constructed in a manner that it does not take longer than 1 week to be completely blocked, to a point that you can no longer get it working without dismantling the watch
  • Construction quality is under parr… less than one year and the wrist band is torn in two… I’m waiting already for 4 weeks (after having paid!!) to get a new one… I’m hoping the money isn’t down the drain!!!!
  • Software really… updates of the software are no longer possible on 2 PC’s … and impossible to remove without “re-installing” the complete PC

Garmin seems to be the worst possible Apple pupil… extremely expensive, but, contrary to Apple, the products are NOT GOOD!!!!

If you are in the EU, have a look at your rights at [https://europa.eu/youreurope/citizens/consumers/shopping/guarantees-returns/index_en.htm]:

Under EU rules, a trader must repair, replace, reduce the price or give you a refund if goods you bought turn out to be faulty or do not look or work as advertised.

If you bought a product or a service online or outside of a shop (by telephone, mail order, from a door-to-door salesperson), you also have the right to cancel and return your order within 14 days, for any reason and without a justification.

    • If your product breaks after 6 months, you still have the right to have your goods repaired or replaced for free or, at least, to a price reduction or your money back. However, you may need to prove that the problem existed when you received the goods.

This may be a challenge for the OP.

That's sure. Waiting one year before trying to get money back will certainly be rather challenging anyway. He better pays a good lawyer a few thousands of € to get his 299€ back Smiley

Fortunately, I have my Instinct since 2 years, and the original wristband does not show any aging signs (yet), despite beeing daily abused rather harshely. However, you can get a replacement wristband from eBay for some 5€, so even if it happened, I do not think I'd ask Garmin to pay me back my 199€ (that's what I paid for my Instinct)
