Approach S60 data collection

For two months now the watch is not recording all my stats. I’ve reported the problem to Garmin and they say I have to be patient and wait for them to fix the problem. My question is as I don’t have full use of my very expensive watch do I have a legal claim against Garmin? All I want is what I’ve paid for, they have told me it’s a soft ware problem so they will not replace the watch
