Vivomove Luxe 010-02241-01 scratched on the case

Hello.
I bought for my wife the watch with the code 010-02241-01 which has sapphire glass, leather bracelet and has the case covered with rose gold.
When I received the watch, I noticed that the case had sharp scratches on the side.
For a luxury watch, it is unacceptable.
Is the case scratching so fast?
I thought it was a scratch resistant watch and the case treatment is durable but it doesn't seem to be.
Have you encountered similar cases?

P.S.
Of course I returned the watch immediately to the seller but they claim that they sent a compliant watch but it seems that they sent one to me second hand.

Of course the watch should not have any scratches when being brand new. But no, the watch case is not scratch resistent. The sapphire glass is, but the case itself is a bit prone to scratches. It can be polished easily with Cape Cod, though. I've been wearing mine for about one year now. I ride trails on my mountainbike almost daily and get caught by branches often. I polish my watch every four to six weeks about 10 mins or so and it still looks like new.
